3. Services Offered / Scope
We provide custom home building, luxury pools, and outdoor-living construction services in Southern Arizona, targeting areas such as Tucson, Marana, Oro Valley, Catalina Foothills, Tanque Verde Valley, and nearby communities. The scope, timeline, materials, and final deliverables for each project will be defined in a separate written agreement/contract between you and the Company.
4. Quotations, Contracts & Payment Terms
All quotes or estimates provided by us are valid for [insert validity period, e.g. 30 days] unless otherwise stated.
A contract becomes binding only once both parties (you and the Company) have signed a written agreement or confirmed acceptance.
Payment terms (deposit, milestone payments, final payment) will be specified in your contract. Failure to meet payment obligations may result in delay or suspension of work.
You agree to pay all amounts specified, including any applicable taxes, fees, or additional charges for changes, extra work, permits, or materials beyond the original scope.
5. Changes, Variations & Cancellation
Any changes, modifications, or variations to the original scope must be documented in writing and may result in adjusted costs and/or revised timelines.
If you cancel the project after agreement, cancellation fees or retention of part/all of any payments or deposits may apply, as specified in your contract.
The Company reserves the right to suspend or terminate work if payment is not received, or if you fail to comply with agreed terms.
6. Delivery, Completion & Handover
Timelines, milestones, and estimated completion dates are provided in the contract. Due to the custom nature of our services, actual completion may vary.
We will make reasonable efforts to meet agreed schedules, but the Company shall not be liable for delays caused by external factors outside of our control (e.g., weather, supply delays, permitting issues, third-party contractor delays, force majeure).
Upon completion, we will walk you through the finished project. Any defects, punch-list items, or required corrections must be reported within [insert period, e.g. 14 days] after handover.
7. Warranties & Limitations
The Company provides a warranty on workmanship for [insert warranty period, e.g. two years], as specified in the contract. This warranty does not cover damage or defects caused by normal wear & tear, misuse, neglect, alterations by third parties, natural disasters, or external factors beyond our control.
We make no other warranties — express or implied — including warranties of merchantability or fitness for a particular purpose, except as explicitly stated in the contract.
To the fullest extent permitted by law, our total liability to you for any damages arising from our services is limited to the amount you paid us under the contract. In no event shall we be liable for indirect, incidental, consequential, or special damages.
8. Use of Website & Intellectual Property
All content on the Website — text, images, graphics, designs, logos — is owned or licensed by the Company. You may view and print for your own reference only; you may not copy, reproduce, republish, distribute, or create derivative works without our prior written consent.
You must not misuse the Website (e.g., attempt unauthorized access, overload servers, use data-scraping tools, post spam/hate/illegal content).
9. Customer Responsibilities & Representations
By engaging our services and/or using the Website, you represent that:
You are at least 18 years old (or otherwise capable of entering legally binding contracts).
You own (or legally control) any land, property, or materials necessary for the project, or have obtained required permissions/approvals for construction.
You will provide accurate and complete information about your property, land, zoning, and other project-relevant facts.
You will comply with all applicable laws, codes, permits, homeowner association (HOA) requirements, and regulations.
10. Termination / Suspension Rights
We reserve the right to suspend or terminate any contract/project if:
You breach any material term (e.g., fail to pay, provide false information, cause delay, violate law or local regulations);
Circumstances beyond our control make performance impossible;
You request cancellation (subject to terms in section 5).
11. Force Majeure
The Company is not liable for delays or failure to perform arising from events beyond our reasonable control — including natural disasters, extreme weather, fire, flood, strikes, supply-chain disruptions, government actions, or other “force majeure” events.
12. Governing Law & Dispute Resolution
These Terms and any contract resulting from them are governed by the laws of the State of Arizona (or applicable jurisdiction). Any dispute arising from or related to these Terms or a contract must be resolved through [mediation / arbitration / court — pick one based on your preference].
13. Severability & Waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable — other provisions remain in full force. Failure to enforce any provision does not constitute a waiver of that right.
14. Changes to Terms
We may update these Terms at any time. The most recent version will always be displayed on the Website. Your continued use of the Website or engagement with our services after changes implies acceptance of the updated Terms.
